Terms of Service

These Terms of Service (“Terms”) govern your use of yayasondemand.com (the “Platform”), operated from Cagayan de Oro City, Philippines. By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
1. What the Platform is — and what it is not
Yayas On Demand is a self-service job board. It allows families to post childcare job openings and allows childcare helpers (“yayas”) to view and apply to those openings and to schedule introductory video calls (“meet & greets”).
- We are not a recruitment, placement, or employment agency, and we are not licensed as one. We do not recruit, select, endorse, place, supply, or guarantee any worker or any employer.
- We are not a party to any employment relationship. Any employment agreement is made directly and exclusively between the family and the yaya, on terms they agree between themselves.
- We do not set, collect, or deduct any portion of any yaya's salary.
2. Eligibility and accounts
- You must be at least eighteen (18) years old and legally capable of entering into contracts.
- You must provide true, accurate, and current information, and keep it updated. One account per person; accounts are personal and may not be sold or transferred.
- You are responsible for keeping your login credentials secure and for all activity under your account.
3. Verification and the “NBI-verified” badge
Yayas must upload a photo of a current NBI clearance issued in their own name before their profile appears on the job board. Our team manually checks that the name matches the account and that the clearance appears current and unaltered.
Important:the “NBI-verified” badge means only that this document check was completed. It is not a background investigation, a character guarantee, or an endorsement. Families remain fully responsible for their own due diligence — interviewing carefully, checking references, and complying with the safety practices in Section 6. Likewise, we do not vet families, and yayas remain responsible for their own due diligence about prospective employers.
4. Fees
- For yayas: the Platform is free. There are no sign-up fees, placement fees, or salary deductions.
- For families:posting a job is free. Fees may apply to unlock applicant profiles or confirm meet & greets; the current fees are always shown before you pay. Except where required by law, fees are non-refundable once the paid feature has been delivered.
5. Your responsibilities
If you hire (families): compliance with the Domestic Workers Act (Batas Kasambahay, Republic Act No. 10361) — including minimum wage, rest days, 13th month pay, and SSS, PhilHealth, and Pag-IBIG registration and contributions — is your responsibility as the employer, not ours.
Prohibited conduct (everyone):
- Uploading fake, altered, expired, or another person's documents, or misrepresenting your identity, experience, or job details.
- Harassment, threats, discrimination contrary to law, or any unlawful conduct toward other users.
- Using the Platform to recruit for agencies, to advertise other services, to spam, or for any purpose other than genuine childcare employment between the parties.
- Scraping, harvesting, or misusing other users' personal information, or circumventing the Platform's fees or safety features.
We may remove content, suspend, or terminate any account that violates these Terms, without prior notice where reasonably necessary to protect users.
6. Safety practices
- Hold the first meeting by video call before any in-person meeting.
- Do not share your exact home address or financial information before a meet & greet is confirmed and you are comfortable proceeding.
- Report suspicious accounts or behavior to us immediately.
7. Content and license
You keep ownership of the content you submit (profiles, job posts, messages). You grant us a non-exclusive, royalty-free license to host and display that content solely to operate the Platform. You are responsible for the accuracy and lawfulness of what you post.
8. Disclaimers and limitation of liability
The Platform is provided “as is” and “as available.” To the maximum extent permitted by Philippine law:
- We make no warranty that any user, profile, job post, or document is accurate, or that any match, interview, or hire will result from using the Platform.
- We are not liable for the acts or omissions of any user, including anything that occurs during or after a meet & greet, an in-person meeting, or an employment relationship.
- Our total liability to you for any claim arising from the Platform shall not exceed the total fees you paid us in the six (6) months before the claim arose, or one thousand pesos (₱1,000) if you paid none.
Nothing in these Terms excludes liability that cannot be excluded under Philippine law, including liability arising from fraud or willful misconduct.
9. Indemnification
You agree to hold us harmless from claims, damages, and expenses (including reasonable attorney's fees) arising from your violation of these Terms, your content, or your dealings with other users.
10. Termination
You may delete your account at any time. We may suspend or terminate accounts as described in Section 5, or discontinue the Platform with reasonable notice. Sections 7 through 12 survive termination.
11. Changes to these Terms
We may update these Terms from time to time. For material changes, we will notify you through the Platform or by email before they take effect; continued use after that date means you accept the updated Terms.
12. Governing law and venue
These Terms are governed by the laws of the Republic of the Philippines. Any dispute that cannot be settled amicably shall be brought exclusively before the proper courts of Cagayan de Oro City, to the exclusion of other venues.
